i bought a gas pump on ebay an the seller has not sent me an invoice an has not replied to my e-mail or phone calls so i fell he is trying to back out of the sale what should i do i won the auction for 127.00 an found out it had a buy it now price of 2,800 but no one used buy it now. i tryed to pay for the item but it wont let me till i receive an invoice from the seller if i dont here back buy monday should i consider filing a breach of contract law suit or take other action's?

I agree with Dick. Let it go. People make mistakes, we all have. I have never, and would never, take advantage of a situation or someones else's misfortune. In the big scheme of things I would rather go to bed knowing I was compassionate and didn't put the boots to someone simply because I could have.
Everyone has their own circumstances and they may need that money more then you. Without getting overly philosophical; life has a way of delivering to us what is meant to be. It's Christmas and the season to be jolly so in the spirit of the season take the higher road (unfortunately the less traveled, now a days).
Hopefully, the person is away on holidays and will send you an invoice upon their return.

I tend to agree with all of the above. Obviously, there should have been some sort of reserve from what you have said? I'd be inclined to walk away. Nothing is worth getting worked up about. Especially on battles you can never win. Paul www.severngaspumps.com

You cannot force a person to sell the item to you. I feel if you win an auction fair and square you should be entitled to the item....you bid what you thought was fair and thats what it sold for....if it was a local auction would the auction house be able to back out....i dont think so. Legal action is a waste of money and time. You can file a dispute with ebay and have them get in contact with the seller.

I also agree with all the above... However, It's the people that email the seller and offer more money after the auction has ended that really irritate me! That happens ALOT!!!! I bought a sign in Mass. buy it now, then posted for help picking it up....The next week a MEMBER posted my sign in buys of the week so I contacted ebay and police! Cops would do NOTHING but ebay/paypal got my $$$ back! If this is the same pump from an earlier post then it wouldnt surprise me a bit if someone has contacted them already!!!

if the auction had a buy it now, you did not win the auction at a bid at $127.00 dollars.just because seller forgot to put a reserve on item does not make it yours.buy it now was $2800.00 DOLLARS,and you think you bought it? move on. you'll have better luck at lotto.

also, you need at least 2 bidders to cancel a buy it now without a reserve.in order to win item.

I am guessing they are not going to let it go. I emailed them for pictures of it and got no reply. I ended up not bidding as I really had no idea what I was buying and I was not going to take a chance on a 6 hour trip one way on it. You might contact Ebay as it may be your only chance.

All you can do is make sure you give some bad feed back quick before he has a chance to make a good excuse. I won a sign fair and square for $150 and I talked with the seller on the phone and he told me it was worth more and I was not getting it .nothing you can do but call them out and don't let up.Remember you entered into a contract for the item make sure they don't try to fault you.

Go to the ebay site map and find the area for contact info. It will ask for the number of the item you are buying and they will email his contact info to you and also email your contact info to him. You can then give him a call and if he has no intention of selling it to you--then forget about it as the others have said. There have been situations where someone ended up sick or stranded, or their computer quit--right before the auction ended. Whatever the case, you'll find out by contacting them! Good luck!

...use Kevin's info to try to call them - I'm guessing they are away from the computer for the holidays...if you don't get a response, or the response is something like 'it's worth more than that', then let them have it with negative feedback...
...IF there was no reserve, and IF the auction ran its course, then 'I forgot to add a reserve', or 'it's worth more than that', is no excuse...he won the auction fair and square - seller's remorse isn't an acceptable excuse either...whatever the Buy It Now price happened to be, is immaterial...
...for all of the people who want to give the seller the benefit of the doubt: for every 'honest mistake', there are many many more who will do or say anything, to avoid honoring their end of the bargain...
...an eBay auction is an auction...the rules are explained beforehand...if you decide not to use a reserve, then 'you rolls your dice and you takes your chances'...if the seller had listed his pump with an auction house, he would not have the luxury of deciding to keep it after the hammer went down...

I agree with all of the above. But ebay, unless the rules have changed, will not be of any help. I had a similar situation years back and ebay told me that they cannot make a seller send an item. Contract or not you have little to no recourse. Negative feedback is about it. Sorry to hear of your loss....frustrating.
