Someone is trying to get the COPYRIGHTS to CAPCO BODIES. IF that happens a lot of collectors/sellers will be S.O.L. for cheap globes on restorations
WHAT'S NEXT ? ? ?

Once one person starts copyrighting then they all will. The only one that wins is the LAWYERS when they fight it out in court.

I'm pretty sure the person is trying to copyright the use of the word 'Capcolite' on a plastic body, therefore they would be the only one able to produce a plastic housing with the Capcolite name. That doesn't affect anyone mfg one without that name on it. That's the way I heard it, but I'm not an expert on anything (except ice cream!). Sounds more like personal vendettas to me.

The prices of plastic bodies (you will notice by fall) is actually starting to drop. Everybody step back from the ledge over the plastic bodies

If I`m not mistaken, I think Scott Anderson has the rights to all Capco bodies. He has all of the old original molds from Cincinnati Advertising. Is someone trying to cut in on him?------Greg

Greg, I have also heard that Scott does have the vintage molds. If someone else wants to trademark the Capcolite or related name they have to state on their application when they started using it. If the Patent Office approves the trademark, the game is not over. All these cases are subject to litigation. If evidence shows that the name was in use before the new trademark holder was involved, his ownership would be very shaky. But this would involve high priced IP lawyers and Federal Courts so there is probably not enough profit in plastic globe bodies to make the fight worthwhile for either party. Unless it's about a grudge, then nothing has to make sense.

There are at least 4 different sources in the country producing plastic globe bodies, this case is over the ability to brand them as CAPCOLITE or not. If this is a simple case of wanting to set yourself apart as the person with the 'original' mold, then more power to them. If it's a pissing contest, why not just donate about $10,000 to charity and walk away NOW, rather than spend 2-3 times that over the next few years.

So does this mean that repop plastic bodies are being produced with the small Reg Us Pat Off and Pat numbers on the bottom? I thought I had a few NOS capolites, could they just be repop? For somereason I thought all the repop bodies did not have this information on the bottom.

This is making Roger's fun hobby not fun anymore. Litigation is NOT good for the hobby yall. Is anyone making a PROFIT off all this nonsense? Everyone should take the high road and just be a community of friends helping each other and not trying to hurt. And the congregation said------------------------------ Amen!!!

Bob...I don't know if it's a secret or not, like I said earlier, I don't put CAPCO on my plastic body nor do I want to, so I really don't have a horse in the race so to speak. One thing I do know, is to limit comments on legal proceedings. The only reason I posted is because I wanted you guys to understand that this doesn't mean that plastic bodies will be sky-rocketing in price anytime soon. No need for any unnecessary panic.....
